Terms and Conditions.
Welcome to Photos By Daz. By booking our services, you agree to the following terms and conditions:
1. Booking and Payments
1.1. A non-refundable deposit of 50% or Full deposit is required to secure your booking (Depending on the photoshoot session. Please contact the photographer to agree on the Booking payment).
1.2. The remaining balance is due on the day of the shoot/event or as otherwise agreed upon in writing or mentioned in the invoice. In wedding photography and videography bookings, The remaining balance is due 14 days before the wedding date.
1.3. Payment methods accepted: Bank transfer Pay
2. Cancellations and Rescheduling
2.1. If the Client cancels the booking, the booking fee will not be refunded.
2.2. In wedding photography and videography bookings, If the Client cancels the Services more than 7 days before the Wedding Date, the Photographer will refund any payments made, minus the non-refundable deposit.
2.3. If the Client cancels the Services within 6 days of the Wedding Date, the Photographer will refund only 50% of payment made, minus the non-refundable deposit.
2.4. If the Photographer is unable to perform the services due to unforeseen circumstances, the deposit will be refunded in full.
2.5. If the Client needs to reschedule the wedding, the Photographer will make reasonable efforts to accommodate the new date. Additional fees may apply.
3. Copyright and Usage Rights
3.1. The Photographer retains full copyright of all images taken during the session.
3.2. The Client is granted a non-exclusive, non-transferable license to use the images for personal use, including social media, personal websites, and prints.
3.3. The Client may not use the images for commercial purposes without written consent from the Photographer.
3.4. The Client agrees not to alter the images without the Photographer's consent.
4. Photographer's Obligations
4.1 The Photographer will arrive at the Location at the agreed time and provide photography services.
4.2 The Photographer will use professional equipment and techniques to capture high-quality images.
4.3 The Photographer will deliver edited images to the Client within 5 weeks after the Wedding Date.
5. Client's Obligations
5.1 The Client will provide the Photographer with a detailed schedule of events and any specific photography requests prior to the event / wedding Date.
5.2 The Client will ensure that the Photographer has access to all locations and necessary permissions to perform the Services.
5.3 The Client will designate a point of contact to assist the Photographer on the Wedding Day.
6. Portfolio Use
6.1. The Photographer reserves the right to use images taken during the session for portfolio purposes, including but not limited to the Photographer's website, social media, marketing materials, and print samples.
6.2. The Client also has the right to use images for their own portfolio purposes, including but not limited to personal websites, social media, and personal marketing materials, provided that proper credit is given to the Photographer where possible.
7. Image Delivery and Editing
7.1. The Photographer will deliver the final edited images within 4 weeks (max) after the shoot/event.
7.2. The Photographer will provide agreed number of edited images in .jpg or .jpeg formats.
7.3. The Client is not allowed to edit, alter, or modify the images without the Photographer’s written permission.
8. Limitation of Liability
8.1. The Photographer is not liable for any loss, damage, or failure to deliver images due to circumstances beyond their control, including but not limited to equipment failure, weather conditions, or any act of God.
8.2. The Photographer’s liability for any claim arising from this agreement is limited to the amount paid by the Client.
8.3.The Photographer will take reasonable care to capture the key moments of the Wedding Day but is not liable for any missed moments or adverse conditions that may affect the quality of the images.
8.4. The Photographer's liability for any claim, breach, or damage is limited to the amount paid by the Client under this Agreement.
9. Model Release
9.1. The Client grants the Photographer the right to use and publish images for editorial, trade, advertising, and other purposes.
9.2. The Client warrants that they have the authority to grant these rights on behalf of all subjects in the images.
10. Confidentiality
10.1. Both parties agree to keep the terms of this agreement confidential, except where disclosure is required by law or where the parties have agreed otherwise in writing.
11. Governing Law
11.1. This agreement shall be governed by and construed in accordance with the laws of Australia.
12. Entire Agreement
12.1. This agreement constitutes the entire understanding between the Photographer and the Client and supersedes all prior discussions, agreements, or understandings of any kind.
